1. ACEPTACIÓN DE LOS TÉRMINOS

Bienvenido a leancontinuo.com (en adelante, el "Sitio Web").

Estos Términos y Condiciones (en adelante, los "Términos") constituyen un acuerdo legal vinculante entre usted (en adelante, el "Usuario") y Leandro Guardia (en adelante, el "Titular"), con domicilio en Santa Cruz de la Sierra, Bolivia.

Al acceder, navegar o utilizar el Sitio Web y cualquiera de sus servicios, incluido el chatbot de inteligencia artificial denominado "Artificial Lean", el Usuario acepta quedar vinculado por estos Términos en su totalidad. 2. DESCRIPCIÓN DEL SERVICIO

El Sitio Web es una plataforma de marca personal que ofrece:

a) Contenido editorial y artículos sobre tecnología, filosofía, desarrollo personal y otros temas de interés del Titular; b) Enlaces a recursos externos, redes sociales y sitios web de terceros; c) Servicio de chatbot interactivo impulsado por inteligencia artificial que utiliza modelos de lenguaje de terceros (principalmente Google Gemini) para generar respuestas a las consultas de los usuarios.

El Titular se reserva el derecho de modificar, ampliar, reducir, suspender o discontinuar cualquier aspecto del Sitio Web o sus servicios en cualquier momento, sin previo aviso y sin incurrir en responsabilidad alguna.

3. CONDICIONES DE USO DEL CHATBOT

3.1. Naturaleza del Servicio

El chatbot "Artificial Lean" es un sistema automatizado basado en inteligencia artificial que genera respuestas mediante modelos de lenguaje de terceros. El Usuario reconoce y acepta que:

a) Las respuestas del chatbot son generadas automáticamente por algoritmos de inteligencia artificial y NO constituyen asesoramiento profesional de ningún tipo (legal, médico, financiero, psicológico, etc.); b) El chatbot puede producir información inexacta, incompleta, desactualizada o errónea; c) Las respuestas no deben ser consideradas como opiniones, recomendaciones o posiciones del Titular; d) El chatbot es una herramienta experimental y conversacional con fines informativos y de entretenimiento.

3.2. Uso Apropiado

El Usuario se compromete a utilizar el chatbot de manera responsable y acepta:

a) No utilizar el chatbot para actividades ilegales, fraudulentas o que infrinjan derechos de terceros; b) No intentar manipular, engañar o explotar vulnerabilidades del sistema de inteligencia artificial; c) No utilizar el chatbot para generar contenido que sea:

Difamatorio, calumnioso, obsceno o pornográfico;
Discriminatorio por motivos de raza, etnia, religión, género, orientación sexual, discapacidad u otra condición protegida;
Amenazante, acosador, intimidatorio o que incite a la violencia;
Que viole derechos de propiedad intelectual de terceros; d) No proporcionar información personal sensible de terceros sin su consentimiento; e) No utilizar el servicio para actividades comerciales no autorizadas o spam.

3.3. Almacenamiento de Conversaciones

El Usuario reconoce y acepta expresamente que:

a) Todas las conversaciones con el chatbot son almacenadas en servidores de terceros (Supabase) para fines de mejora del servicio, análisis y seguridad; b) Los mensajes son compartidos con Google LLC (Gemini AI) para el procesamiento y generación de respuestas; c) Las conversaciones se conservan durante aproximadamente un (1) año; d) El Usuario no debe compartir información confidencial, secretos comerciales, contraseñas, datos financieros o cualquier información que no desee que sea almacenada o procesada por terceros.

4. CONTENIDO GENERADO POR EL USUARIO

Al interactuar con el chatbot, el Usuario otorga al Titular una licencia mundial, no exclusiva, libre de regalías, perpetua e irrevocable para:

a) Almacenar, procesar y analizar los mensajes enviados; b) Utilizar los datos de forma agregada y anonimizada para mejorar el servicio; c) Utilizar fragmentos de conversaciones con fines de investigación, desarrollo o demostración, previa anonimización que impida la identificación del Usuario.

El Usuario declara y garantiza que:

a) Es el titular de todos los derechos sobre el contenido que envía o tiene las autorizaciones necesarias; b) El contenido enviado no infringe derechos de terceros ni viola legislación alguna; c) Acepta asumir toda responsabilidad derivada del contenido que envía al chatbot.

5. PROPIEDAD INTELECTUAL

5.1. Derechos del Titular

Todos los elementos del Sitio Web, incluyendo pero no limitándose a diseño, gráficos, textos, código fuente, logotipos, marcas, nombres comerciales, estructura, organización y compilación de contenido, son propiedad exclusiva del Titular o de terceros que han otorgado licencia de uso, y están protegidos por las leyes de propiedad intelectual e industrial aplicables en Bolivia y tratados internacionales.

Queda expresamente prohibido:

a) Reproducir, copiar, distribuir, comunicar públicamente, transformar o modificar cualquier contenido del Sitio Web sin autorización previa y escrita del Titular; b) Utilizar técnicas de web scraping, crawling o extracción automatizada de datos sin consentimiento expreso; c) Realizar ingeniería inversa, descompilar o desensamblar cualquier elemento del Sitio Web; d) Eliminar, alterar u ocultar avisos de derechos de autor, marcas registradas u otros avisos de propiedad.

5.2. Contenido Generado por Inteligencia Artificial

Las respuestas generadas por el chatbot mediante modelos de inteligencia artificial de terceros NO son propiedad del Titular. El Usuario puede utilizar libremente el contenido generado por el chatbot, pero el Titular no asume responsabilidad alguna por:

a) La originalidad o ausencia de infracciones de propiedad intelectual en las respuestas generadas; b) El uso que el Usuario haga del contenido generado por el chatbot; c) Cualquier consecuencia derivada de la utilización de respuestas del chatbot.

6. EXCLUSIÓN DE GARANTÍAS

El Sitio Web y todos sus servicios se proporcionan "TAL CUAL" y "SEGÚN DISPONIBILIDAD", sin garantías de ningún tipo, ya sean expresas o implícitas.

El Titular no garantiza:

a) Que el Sitio Web esté libre de errores, virus, malware u otros componentes dañinos; b) Que el servicio será ininterrumpido, oportuno, seguro o libre de fallos; c) La exactitud, fiabilidad, integridad o utilidad de cualquier información proporcionada; d) Que las respuestas del chatbot sean precisas, completas, actuales o aplicables a situaciones específicas del Usuario; e) Que los defectos del servicio serán corregidos.

7. LIMITACIÓN DE RESPONSABILIDAD

En la máxima medida permitida por la legislación aplicable, el Titular NO será responsable de:

a) Daños directos, indirectos, incidentales, especiales, consecuenciales o punitivos derivados de:

El uso o imposibilidad de uso del Sitio Web o el chatbot;
Información incorrecta, incompleta o engañosa generada por el chatbot;
Decisiones tomadas por el Usuario basándose en respuestas del chatbot;
Pérdida de datos, beneficios, oportunidades comerciales o reputación;
Acceso no autorizado a datos del Usuario;
Errores técnicos, interrupciones del servicio o fallos de seguridad;

b) Contenido de terceros: El Sitio Web puede contener enlaces a sitios externos. El Titular no controla, respalda ni asume responsabilidad por el contenido, políticas de privacidad o prácticas de sitios de terceros;

c) Actos del Usuario: Cualquier consecuencia derivada del uso inadecuado, ilegal o no autorizado del Sitio Web por parte del Usuario.

El Usuario acepta expresamente que utiliza el Sitio Web y el chatbot bajo su propio riesgo y asume toda responsabilidad por cualquier consecuencia derivada de dicho uso.

8. INDEMNIZACIÓN

El Usuario se compromete a indemnizar, defender y mantener indemne al Titular, sus representantes, empleados y colaboradores frente a cualquier reclamación, demanda, pérdida, daño, responsabilidad, costo o gasto (incluidos honorarios de abogados) que surjan de o estén relacionados con:

a) El uso del Sitio Web o del chatbot por parte del Usuario; b) El incumplimiento de estos Términos por parte del Usuario; c) La violación de derechos de terceros por parte del Usuario; d) El contenido enviado por el Usuario al chatbot.

9. TERMINACIÓN Y SUSPENSIÓN

El Titular se reserva el derecho, a su exclusiva discreción y sin previo aviso, de:

a) Suspender o terminar el acceso del Usuario al Sitio Web o al chatbot; b) Eliminar o modificar cualquier contenido del Sitio Web; c) Discontinuar el servicio de chatbot temporal o permanentemente.

Motivos para suspensión o terminación incluyen, sin limitación:

Violación de estos Términos;
Uso fraudulento, abusivo o ilegal del servicio;
Actividades que pongan en riesgo la seguridad o integridad del Sitio Web;
Solicitud de autoridades competentes.

10. MODIFICACIONES A LOS TÉRMINOS

El Titular se reserva el derecho de modificar estos Términos en cualquier momento. Las modificaciones entrarán en vigor inmediatamente tras su publicación en el Sitio Web.

El Usuario será notificado de cambios sustanciales mediante un aviso visible en el Sitio Web. El uso continuado del Sitio Web tras la publicación de modificaciones constituye la aceptación de los nuevos Términos.

11. DIVISIBILIDAD

Si cualquier disposición de estos Términos es declarada inválida, ilegal o inaplicable por un tribunal competente, dicha disposición será eliminada y el resto de los Términos permanecerá en pleno vigor y efecto.

12. RENUNCIA

La omisión del Titular de ejercer o hacer cumplir cualquier derecho o disposición de estos Términos no constituirá una renuncia a dicho derecho o disposición.

13. ACUERDO COMPLETO

Estos Términos, junto con la Política de Privacidad y el Aviso Legal del Sitio Web, constituyen el acuerdo completo entre el Usuario y el Titular respecto al uso del Sitio Web, y reemplazan todos los acuerdos anteriores o contemporáneos, escritos u orales.

14. LEGISLACIÓN APLICABLE Y JURISDICCIÓN

Estos Términos se regirán e interpretarán de conformidad con las leyes de Bolivia.

Para cualquier controversia derivada de o relacionada con estos Términos, el Sitio Web o el uso del chatbot, las partes se someten expresamente a la jurisdicción exclusiva de los tribunales competentes de Santa Cruz, Bolivia, con renuncia a cualquier otro fuero que pudiera corresponderles.

3. CHATBOT USAGE CONDITIONS

3.1. Nature of Service

The "Artificial Lean" chatbot is an automated system based on artificial intelligence that generates responses using third-party language models. The User acknowledges and accepts that:

a) Chatbot responses are automatically generated by artificial intelligence algorithms and DO NOT constitute professional advice of any kind (legal, medical, financial, psychological, etc.); b) The chatbot may produce inaccurate, incomplete, outdated, or erroneous information; c) Responses should not be considered as opinions, recommendations, or positions of the Owner; d) The chatbot is an experimental and conversational tool for informational and entertainment purposes.

3.2. Appropriate Use

The User agrees to use the chatbot responsibly and accepts:

a) Not to use the chatbot for illegal, fraudulent activities or those that infringe third-party rights; b) Not to attempt to manipulate, deceive, or exploit vulnerabilities of the artificial intelligence system; c) Not to use the chatbot to generate content that is:

Defamatory, slanderous, obscene, or pornographic;
Discriminatory based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected condition;
Threatening, harassing, intimidating, or inciting violence;
Violating third-party intellectual property rights; d) Not to provide sensitive personal information of third parties without their consent; e) Not to use the service for unauthorized commercial activities or spam.

3.3. Conversation Storage

The User expressly acknowledges and accepts that:

a) All conversations with the chatbot are stored on third-party servers (Supabase) for service improvement, analysis, and security purposes; b) Messages are shared with Google LLC (Gemini AI) for processing and generating responses; c) Conversations are retained for approximately one (1) year; d) The User must not share confidential information, trade secrets, passwords, financial data, or any information they do not wish to be stored or processed by third parties.

4. USER-GENERATED CONTENT

By interacting with the chatbot, the User grants the Owner a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to:

a) Store, process, and analyze sent messages; b) Use data in aggregated and anonymized form to improve the service; c) Use conversation fragments for research, development, or demonstration purposes, after anonymization preventing User identification.

The User declares and warrants that:

a) They hold all rights to the content they submit or have necessary authorizations; b) The submitted content does not infringe third-party rights or violate any legislation; c) They accept full responsibility for content sent to the chatbot.

5. INTELLECTUAL PROPERTY

5.1. Owner's Rights

All elements of the Website, including but not limited to design, graphics, texts, source code, logos, trademarks, trade names, structure, organization, and content compilation, are the exclusive property of the Owner or third parties who have granted usage licenses, and are protected by intellectual and industrial property laws applicable in Bolivia and international treaties.

The following is expressly prohibited:

a) Reproducing, copying, distributing, publicly communicating, transforming, or modifying any Website content without prior written authorization from the Owner; b) Using web scraping, crawling, or automated data extraction techniques without express consent; c) Reverse engineering, decompiling, or disassembling any Website element; d) Removing, altering, or concealing copyright notices, trademarks, or other proprietary notices.

5.2. AI-Generated Content

Responses generated by the chatbot using third-party artificial intelligence models are NOT the property of the Owner. The User may freely use content generated by the chatbot, but the Owner assumes no responsibility for:

a) The originality or absence of intellectual property infringements in generated responses; b) The User's use of content generated by the chatbot; c) Any consequences arising from using chatbot responses.

6. DISCLAIMER OF WARRANTIES

The Website and all its services are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied.

The Owner does not warrant:

a) That the Website is free from errors, viruses, malware, or other harmful components; b) That the service will be uninterrupted, timely, secure, or error-free; c) The accuracy, reliability, completeness, or usefulness of any information provided; d) That chatbot responses are accurate, complete, current, or applicable to the User's specific situations; e) That service defects will be corrected.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the Owner SHALL NOT BE LIABLE for:

a) Direct, indirect, incidental, special, consequential, or punitive damages arising from:

Use or inability to use the Website or chatbot;
Incorrect, incomplete, or misleading information generated by the chatbot;
Decisions made by the User based on chatbot responses;
Loss of data, profits, business opportunities, or reputation;
Unauthorized access to User data;
Technical errors, service interruptions, or security failures;

b) Third-party Content: The Website may contain links to external sites. The Owner does not control, endorse, or assume responsibility for the content, privacy policies, or practices of third-party sites;

c) User Actions: Any consequences arising from inappropriate, illegal, or unauthorized use of the Website by the User.

The User expressly accepts that they use the Website and chatbot at their own risk and assume all responsibility for any consequences arising from such use.

8. INDEMNIFICATION

The User agrees to indemnify, defend, and hold harmless the Owner, their representatives, employees, and collaborators from any claim, demand, loss, damage, liability, cost, or expense (including attorney fees) arising from or related to:

a) The User's use of the Website or chatbot; b) The User's breach of these Terms; c) Violation of third-party rights by the User; d) Content submitted by the User to the chatbot.

9. TERMINATION AND SUSPENSION

The Owner reserves the right, at their sole discretion and without prior notice, to:

a) Suspend or terminate the User's access to the Website or chatbot; b) Remove or modify any Website content; c) Discontinue the chatbot service temporarily or permanently.

Grounds for suspension or termination include, without limitation:

Violation of these Terms;
Fraudulent, abusive, or illegal use of the service;
Activities that jeopardize the security or integrity of the Website;
Request from competent authorities.

10. MODIFICATIONS TO TERMS

The Owner reserves the right to modify these Terms at any time. Modifications will take effect immediately upon publication on the Website.

The User will be notified of substantial changes through a visible notice on the Website. Continued use of the Website after publication of modifications constitutes acceptance of the new Terms.

11. SEVERABILITY

14. APPLICABLE LAW AND JURISDICTION
